GeoFolder Privacy Statement

This privacy statement applies to and related services and applications offered directly by Geofolder Inc. (“GeoFolder”)

Disclaimers and Super Important Information

GeoFolder helps individuals and organizations comply with privacy laws, regulations and best practices by providing a safe, secure cloud solution that respects data sovereignty and storage laws.

However, using GeoFolder alone is not enough to guarantee privacy, in much the same way that a vehicle that meets safety standards does not guarantee the vehicle will be driven safely by the driver. The driver still has an obligation to drive safely themselves.

Likewise, GeoFolder cannot protect your organization from privacy violations if:

  • The information being stored was not lawfully collected
  • The files or information is shared by a user with parties that do not have a right to access them
  • The organization does not practice good security on it’s part; such as having a poor password policy, insufficient control over computers with access to Geofolder accounts, etc.
  • Reasonable, educated and appropriate care is not taken throughout the entire collection and handling of private information process from beginning to end.

GeoFolder is an important part of a privacy protection platform for organizations, and takes care of many of the technical aspects of privacy compliance in the digital cloud age, but it is responsibility of every individual and organization to make certain that their entire data collection and communication system complies with the applicable privacy laws, regulations and best practices.

Special Note: The intent and purpose of GeoFolder is to provide world-class cloud services that protect our users privacy and comply with privacy legislation. GeoFolder is designed to help you obey the law, not break it. We will not knowingly allow anyone to use GeoFolder break the law, and you agree to this by using our service.

Who This Applies To

This privacy statement is written for the individual, organization or company (our “customer”) that contracts with Geofolder. All references to “you” or “your” in this privacy statement are to our customers, who in turn, may administer the GeoFolder accounts to end users. GeoFolder is not responsible for the privacy or security practices of our customers, which may differ from those set forth in this Privacy Statement. End users of GeoFolder services administered by GeoFolder customers should direct privacy inquiries to their network administrator. Be advised that if you obtain a Geofolder account using an Admin Account, the owner of the Admin Account (e.g., your employer) may subsequently be able to assume control of your account and obtain access to your data and past network activities.

Cookies and Analytics

GeoFolder uses “cookies,” small text files that can be read by a web server in the domain that put the cookie on your local storage, or similar technologies such as web beacons. These are used to store your preferences and settings; to authenticate a user, detect fraud, help with sign-in, help GeoFolder applications work with each other, and analyze site operations.

In addition, we use Google Analytics to analyze our site functionality, which sets it’s own cookies. No personally identifiable information is tagged or sent to Google. Google Analytics is NOT used after you are logged into GeoFolder – only the public site sales and usability web usage data is collected by Google Analytics on

Once logged into your account, we no longer track your usage using Analytics. However, the account Auditing Log will record logged in users activities, as is required by privacy law. This log is available to you to view but is not editable. If you have an account provided to you by your employer, they may be able to view your logs, as well, if they have chosen to implement that option.

Customer Data

Customer Data will be used only for purposes compatible with the provision of GeoFolder services. GeoFolder will not use Customer Data or derive information from it for any advertising or similar commercial purposes. Customer Data is not Administrator Data, Payment Data or Support Data.

Administrative Data

Administrative Data is information about subscriptions and customers (including developers of applications hosted in or developed using GeoFolder) that is provided during sign-up, purchase, or administration of GeoFolder.

Administrative Data may include the customers name, address, phone number, and e-mail address. We use Administrative Data to provide GeoFolder Services, complete transactions, administer the account and detect and prevent fraud. We may contact customers to provide information about their subscriptions, billing and updates to GeoFolder, including information about new features, security or other technical issues. Customers will not be able to unsubscribe from these communications, since they are critical to the operation of your account.

Customers may manage their contact preferences or update information in their account profile.

Payment Data

Customers who make online purchases will be asked to provide information, which may include payment instrument number (e.g., credit card), name and billing address, and the security code associated with the payment instrument and other financial data (“Payment Data”). We use Payment Data to complete transactions, as well as to detect and prevent fraud. When you provide Payment Data while logged in we may, with your permission, store that data to help you complete future transactions.

Support Data

Support Data is the information we collect when you submit a support request or run an automated troubleshooter, including information about hardware, software, and other details related to the support incident, such as contact or authentication information, chat session personalization, information about the condition of the machine and the application when the fault occurred and during diagnostics, system and registry data about software installations and hardware configurations, and error-tracking files.

Support may be provided through phone, e-mail, or online chat. We may use Remote Access (“RA”), with your permission, to temporarily navigate your machine. Phone conversations, online chat sessions, or RA sessions with support professionals may be recorded and/or monitored. We use Support Data as described in this privacy statement, to resolve your support incident and for training purposes.

Following a support incident, we may send you a survey about your experience and offerings. You may opt-out of support surveys.

Some customers may purchase enhanced support offerings. These offerings are covered by separate overriding terms and notices.

Data Location

Customer Data that GeoFolder processes on your behalf will be stored in the jurisdiction chosen by the user. Encrypted Customer Data may be transferred to or through other countries “in transit” as part of the normal operation of networks and the internet. You appoint GeoFolder to perform any such transfer of Customer Data to the user specified country and to store and process Customer Data in order to provide the GeoFolder services. GeoFolder abides by data privacy laws in every jurisdiction we offer storage in.

Disclosure of Data

GeoFolder will not disclose Customer Data outside of GeoFolder except (1) as you direct, (2) with permission from an end user, (3) as described here or in your agreement(s), or (4) as required by law.

GeoFolder will not disclose Customer Data to law enforcement unless required by law applicable to the data’s jurisdiction. Should law enforcement contact GeoFolder with a demand for Customer Data, GeoFolder will attempt to redirect the law enforcement agency to request that data directly from you. If compelled to disclose Customer Data to law enforcement, then GeoFolder will promptly notify you and provide you a copy of the demand unless legally prohibited from doing so.

Upon receipt of any other third party request for Customer Data (such as requests from customer’s end users), GeoFolder will promptly notify you unless prohibited by law. If GeoFolder is not required by law to disclose the Customer Data, GeoFolder will reject the request. If the request is valid and GeoFolder could be compelled to disclose the requested information, GeoFolder will attempt to redirect the third party to request the Customer Data from you directly.

Except as customer directs, GeoFolder will not provide any third party: (1) direct, indirect, blanket or unfettered access to Customer Data; (2) the platform encryption keys used to secure Customer Data or the ability to break such encryption; or (3) any kind of access to Customer Data if GeoFolder is aware that such data is used for purposes other than those stated in the request.

In support of the above, GeoFolder may provide your basic contact information to the third party.

We will not disclose Administrator Data, Payment Data or Support Data outside of GeoFolder except (1) as you direct, (2) with permission from an end user, (3) as described here or in your agreement(s), or (4) as required by law. We may share Administrator Data or Payment Data with third parties for purposes of fraud prevention or to process payment transactions.

GeoFolder may enable you to purchase, subscribe to, or use services, software, and content from companies other than GeoFolder (“Third Party Offerings”). If you choose to purchase, subscribe to, or use a Third Party Offering, we may provide the third party with your Administrator Data or Payment Data to enable the third party to provide its offering to you. Use of that information and your use of a Third Party Offering will be governed by the third party’s privacy statement and policies.

GeoFolder may use and disclose high level anonymous aggregate information, such as how many total users we have, or country specific growth rates, in order to secure financing, plan new infrastructure, encourage adoption and similar purposes.


GeoFolder is committed to helping protect the security of your information. We have implemented and will maintain appropriate technical and organizational measures intended to protect your information against accidental loss, destruction, or alteration; unauthorized disclosure or access; or unlawful destruction. Customers will be notified as quickly as possible in the event of any breach or incident that may affect them. Breach Reporting is Mandatory.

GeoFolder Applications

Some GeoFolder services may require, or may be enhanced by, the installation of local software such as desktop tools, agents, etc, referred collectively here as “Apps”. This section of the Privacy Statement governs your use of those GeoFolder Apps that do not have their own privacy statements. At your or your end user’s direction, the Apps transmit data, which may include Customer Data from a device or appliance to or from GeoFolder.

The Apps may collect other information about the use and performance of the Apps that may be transmitted to GeoFolder and analyzed for purposes of improving the quality, security, and integrity of our products or services. Some Apps may have logging capabilities that permit you to transmit data to GeoFolder for troubleshooting purposes.

Use of Subcontractors

GeoFolder may hire subcontractors to provide services on its behalf. Any such subcontractors will be permitted to obtain data only to deliver the services GeoFolder has retained them to provide and will be prohibited from using data for any other purpose. Sub-Contractors are required to adhere to GeoFolder Security and Privacy Policies at all times.

Changes to this Privacy Statement

We will occasionally update our privacy statements to reflect customer feedback and changes in our Online Services. When we post changes to a statement, we will revise the “last updated” date at the top of the statement. If there are material changes to the statement or in how GeoFolder will use privacy sensitive information, we will notify you either by posting a notice of such changes before they take effect or by directly sending you a notification. In the event of a conflict between the terms of any agreement(s) between you and GeoFolder and this privacy statement, the terms of those agreement(s) will control.
